Fiscal Impact/Change to Net County Cost:
The authorization of $115,902 from the El Dorado-Sacramento Municipal Utility District Cooperation Agreement Fund (SMUD) will provide matching funds for three (3) Highway Bridge Program (HBP) grants saving the use of Road Fund monies.  The three (3) projects are the Rubicon Trail at Ellis Creek - Bridge Replacement Project (CIP No. 77117), Ice House Road Bridges-Maintenance (CIP No. 77121) and Ice House Road at Jones Fork Silver Creek - Bridge Maintenance Project (CIP No. 77131).  There is no change to Net County Cost.
Background:
On October 18, 2005, the County entered into a Cooperation Agreement with Sacramento Municipal Utility District (El Dorado-SMUD Cooperation Agreement) (Agreement), which provided funding for various County activities with respect to the Ice House Road area. The Rubicon Trail is part of the Ice House Road area. Pursuant to Section 4.4 within this Agreement, the County can use the funds for "capital improvements to Ice House Road and other miscellaneous capital projects related to the UARP (Upper American River Project) and its impacts on facilities owned or services provided by, or any resource or other interest within the jurisdiction of, the County."
On May 19, 2010, District III Supervisor Jack Sweeney sent a letter to the Board of Supervisors (Board) reiterating the intention of the Agreement and the intended use of the SMUD Funds to facilitate projects that mitigate sedimentation flowing into streams and creeks that feed SMUD's Loon Lake facility.
On November 13, 2012, the Board approved Item # 29 which established the distribution of future SMUD revenues to pre-determined subaccounts for Georgetown Divide Public Utility District, maintenance, law enforcement and a reserve account to be used for recreational programs, mainline roads or additional law enforcement.
Reason for Recommendation:
The Department of Transportation (Department) is recommending the Board authorize the use of SMUD funds from the reserve account, in the amount of $115,902, to provide the 11.47% local match for the allocated HBP grant funds.  The Rubicon Trail at Ellis Creek - Bridge Replacement Project will be proceeding to construction in FY 12/13 and the completion of that project will decrease the amount of sedimentation in the watershed by allowing vehicles to use the bridge instead of driving through the creek.  The Ice House Road Bridges- Maintenance Project replaced joint seals, deck rehabilitation and resurfacing and leveling roadway approaches to five bridges located along Ice House Road during the 2012 construction season. The Ice House Road at Jones Fork Silver Creek - Bridge Maintenance Project, which is beginning the planning phase, will replace the bearings and other minor maintenance tasks not included in the recently completed CIP Project No. 77121.  
 
The Department anticipates returning to the Board in the future to request additional grant match funding from the reserve account for overlays on Ice House Road as grant funding becomes available.  
 
Action to be taken by the Department following Board approval:
The Department will request reimbursement for work associated with the three (3) HBP projects from the SMUD Fund (Account 7702317).
