Title: Health and Human Services Agency, Mental Health Division, recommending the Board consider the following: 1) Authorize the Health and Human Services Agency Director to sign a Restated Joint Exercise of Powers Agreement with California Mental Health Services Authority (El Dorado County 142-O1111) that governs the operations of the California Mental Health Services Authority with a term that began July 1, 2009 and has no end term. The Restated Joint Exercise of Powers Agreement is effective July 1, 2013; and 2) Authorize the Health and Human Services Agency Director to execute further documents relating to 142-O1111, including amendments thereto, contingent upon approval by County Counsel and the Chief Administrative Officer with regard to the California Mental Health Services Authority and participation therein, in accordance with Resolution 024-2011. Background
California Government Code Sections 6500 through 6536 permit two or more public agencies by agreement to jointly exercise powers common to the contracted parties.  In collaboration with the California Mental Health Directors Association ("CMHDA"), a Joint Exercise of Powers Authority ("JPA") was developed to administer the statewide training, technical assistance, and capacity building of the Proposition 63 Mental Health Services Act ("MHSA") Prevention and Early Intervention ("PEl") programs, as well as other programs as needed.  The California Mental Health Services Authority ("CalMHSA") was created in 2009 to allow member counties the opportunity to collaborate with all other members for the administration of the statewide projects.  Each member county has representation on the Authority's Board of Directors and the ability to attend, participate in, and vote on actions of the Board of Directors.
 
On February 25, 2011, the Board of Supervisors adopted Resolution 024-2011 (File 10-1324) approving membership and participation in the JPA, and authorizing the Director of Health Services to sign Agreement 142-O1111, as well as future ancillary documents with regard to the JPA and participation therein.  That original Agreement 142-O1111 assigned MHSA funds to allow the JPA to operate as the central entity to administer, in accordance with the guidelines established by the Mental Health Services Oversight and Accountability Commission, three PEI Statewide Projects: Suicide Prevention, Student Mental Health Initiative, and Stigma and Discrimination Reduction.  
 
Now that the Statewide PEI projects have been successfully launched and the value of the CalMHSA JPA recognized, the CMHDA and the Member Counties want CalMHSA to take on other roles, including the Statewide PEI projects.  The CMHDA and the member counties have found that the existing JPA may be too narrowly drafted and support CalMHSA taking on roles other than were initially contemplated.  Therefore the CalMHSA Board and CMHDA have requested approval of the Restated Joint Exercise of Powers Agreement 142-O1111, focused primarily on expanding the CalMHSA breadth of programs to include all mental and or behavioral health programs.  It also includes clarifying language on elections, committee structure, the responsibilities of the Executive Committee and the Board of Directors.
 
Reason for Recommendation
Approval of the Restated Joint Exercise of Powers Agreement by the Board allows the CalMHSA JPA to perform additional services including joint contracting for State hospital beds, joint administration of other State or Federal programs, provision of fiscal, administrative services, research, development and other requests from the CMHDA and/or California State Association of Counties.  These changes do not impose any additional obligation on the County and the County is not obligated to participate in any added programs or services.  Each county determines whether it will participate in a program and, with Board approval, will pay only its share of those programs in which it chooses to participate.  Members have no financial obligation for programs in which they do not participate.  
 
Action(s) to be taken following Board approval
1. Health and Human Services Agency ("HHSA")  Director to sign two (2) original Restated Joint Exercise of Powers Agreement 142-O1111.
2. HHSA to submit signed originals of 142-O1111 to CalMHSA for final execution.
4. Upon receipt of fully executed 142-O1111 from CalMHSA, HHSA to submit same to Board Clerk's Office.
