Fiscal Impact/Change to Net County Cost:  The total amount of the new funding agreement is $5,171,662 with 75% received as an advance and the remaining 25% received when required reports are filed and approved by the California Department of Mental Health.  There is no Change to Net County Cost.
 
Background:  In November 2004, California voters passed Proposition 63, now known as the Mental Health Services Act (MHSA).  In January 2006, the Board approved submittal to the State of the Department's three-year plan for MHSA Community Services and Supports. This three-year plan was formally approved by the State on April 28, 2006, and El Dorado County was authorized to receive MHSA funding effective the first day of the month of approval - April 1, 2006.
 
In El Dorado County, MHSA finances an integrated services program for mentally ill adults and transitional age youth; a wraparound program for children and transitional age youth; a Mental Health Court program in South Lake Tahoe; an older adult outreach program; and a Latino outreach program.  The MHD is also beginning implementation of Workforce Education and Training planning and Prevention Early Intervention planning with funds from this contract.  
 
Reason for Recommendation:
Presently, the El Dorado County Mental Health Department (MHD) has a contract in force with the State of California Department of Mental Health (DMH) for implementation of Mental Health Services Act (MHSA) program activities.  The term of this agreement is from April 1, 2006 through June 30, 2008.
 
The new agreement will replace the existing agreement, increase the contract amount from $4,125,093 to $5,171,662 and extend the term to include spending related to MHSA implementation costs back to July 1, 2004.  The new contract provides benefits to the County as described below.
 
1.  Community Program Planning (CPP) FY 2004/05.  
The contract term is modified back to July 1, 2004 and includes provisions for Community Program Planning spending during Fiscal Year 2004-05.  When Proposition 63 was passed in 2004, MHD began a Community Planning Process (CPP) as required by MHSA for development of a Community Services and Supports (CSS) plan-- the first MHSA component the DMH rolled out.  The costs for completing a CPP were not contemplated in prior contracts.  Nonetheless, MHD did receive planning funds after applying for them with letters from DMH serving as the supporting paperwork to the original agreement.  The new MHSA agreement incorporates the preceding agreement and letters from DMH into a single contract, and for this reason the contract references prior fiscal years and adds items such as Community Planning Process.  Additionally, MHD spent Realignment funds for CPP costs and this contract clarifies that unspent CSS funds can be used to cover CPP costs and allows MHD to collect funds to cover those past costs, with adjustments made to Realignment accordingly.  
 
2.  Community Services and Supports (CSS) FY 2005-06 - 2007-08.
The MHD received a revised planning estimate for FY 2007-08 that provided for the addition of "expansion funds" for MHSA program activities.  The new agreement adds funds for expansion of existing Community Services and Supports (CSS) activities as detailed in the attachment.
 
3.  Workforce Education and Training (WET) FY 06/07.  
Counties were allowed to apply for funds to cover the "early planning" costs of MHSA programs.  The new agreement provides for the addition of Workforce Education and Training activity and the ability to cover the early planning costs for that activity back to FY 2006-07.  MHD began incurring WET planning expenses during FY 2007-08.
 
Action to be taken following Board approval:
 
1.      Chairman of the Board will sign Resolution and of Agreement documents.
 
2.      Board Clerk's Office will forward the executed agreement and a copy of the resolution to the Mental Health Department.
 
3.      Mental Health Department will forward to the Procurement and Contracts division of the Chief Administrator's Office one fully executed agreement with original signatures, together with supporting administrative documents.
 
4.      Mental Health Department will forward to California Department of Mental Health one fully executed agreement with original signatures.
