DEPARTMENT RECOMMENDATION:

Community Development Agency, Transportation Division, recommending the Board approve and authorize the Chair to sign the First Amendment (Amendment) to the Integrated Regional Water Management Plan Intergovernmental Agreement 12-53471 (Agreement), increasing the awarded funds by $18,178 and extending the expiration date to December 31, 2016.

 

DISCUSSION / BACKGROUND

The 2007 Tahoe Sierra Integrated Regional Water Management Plan (IRWMP), which enables the coordination of water quality and resource management efforts between jurisdictions within the Lake Tahoe Regional Watershed, was adopted by the Board on November 6, 2012 (Item 16), and the subsequent update to the IRWMP was adopted on January 27, 2015 (Item 44).  Adoption of the IRWMP allowed the County to apply for grant funds under Proposition 84 (Prop 84), the Safe Drinking Water, Water Quality and Supply, Flood Control and Coastal Protection Bond Act of 2006.

 

The County was awarded $186,818 from Prop 84 through the Tahoe Sierra IRWMP group for the Montgomery Estates Area 2 Erosion Control Project - CIP 95170 (Project).  South Tahoe Public Utility District (STPUD) is the IRWMP grant administrator for Prop 84 and the Board approved the Agreement with STPUD on February 25, 2013 (Item 10) to receive the funds.  The expiration date of the performance period for this Agreement was April 30, 2016, which matched the expiration date of the grant.  STPUD requested and received approval for an extension of the grant expiration date to December 31, 2016.  The proposed change to the Agreement would extend the expiration date of the performance period to match the updated expiration date of the grant.

 

STPUD also notified the partner agencies of the availability of additional grant funds that have not been expended by other agencies also participating in the IRWMP. The County proposed and was approved to use $18,178 in additional funds to address eroding slopes in the Project area that were identified in the approved environmental document.  The proposed change to the Agreement increases the total award to the County from $186,818 to $204,996.

 

ALTERNATIVES:

If the Board chooses to not approve the Amendment to extend the term of the Agreement and accept the additional funds, no additional work will be completed within the Project area.

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT:

County Counsel reviewed and approved the proposed Amendment.

CAO RECOMMENDATION:

Chief Administrative Office concurs with staff's recommendations.

 

FINANCIAL IMPACT:

The proposed Amendment would have no impact to Net County Cost.  The proposed Amendment would increase available funding for the Project.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair’s signature on the two (2) partially executed original Agreements.

2) The Clerk of the Board will forward the two (2) partially executed Agreements to the Transportation - Tahoe Engineering Unit (Patty Scott) for further processing.
