DEPARTMENT RECOMMENDATION

Community Development Agency, Administration and Finance Division, recommending the Board adopt and authorize the Chair to sign Resolution 179-2016 making certain findings as required under the Mitigation Fee Act (Cal. Gov. Code §66000 et seq.) related to the Traffic Impact Mitigation (TIM) Fee collected by the County for Fiscal Years 2010/11, 2011/12, and 2012/13, as required for the particular impact fund. 

 

DISCUSSION / BACKGROUND

The Mitigation Fee Act (Act) (Cal. Gov. Code §66000 et seq.) requires reports annually and every five years following the first deposit of the Fee.  The attached Resolution (Attachment B) makes findings which are required by the Act (66001(d)).  Exhibit A (Attachment C) contains all TIM Fee Compliance Reports from 2002 through 2015.

 

The County’s Capital Improvement Program (CIP) Books, Exhibits B-1 through B-3, identify the approximate dates for the deposit of additional funding as required by the Act Section 66001(d)(1)(D).  Exhibit B-1 (Attachment D) is the 2010 CIP Book.  Exhibit B-2 (Attachment E) is the 2012 CIP Book.  Exhibit B-3 (Attachment F) is the 2013 CIP Book.

 

Exhibits C through H contain information regarding each TIM Fee account and the amount of funding in each account available to complete financing of incomplete improvements identified in Paragraph 2 of Subdivision (a) of Section 66001 of the Act.   Exhibit C (Attachment G) is the 2004 El Dorado Hills TIM Fund Report.  Exhibit D (Attachment H) is the 2004 Silva Valley Interchange TIM Fund Report.  Exhibit E (Attachment I) is the 2004 TIM Fund Zones 1-7 Report.  Exhibit F (Attachment J) is the 2004 Highway 50 TIM Fund Report.  Exhibit G (Attachment K) is the West Slope TIM Fund Report.  Exhibit H (Attachment L) is the Interim Highway 50 TIM Fund Report.

 

The findings are supported by reports on fee activity that has been produced by the Community Development Agency, Administration and Finance Division, and presented to the Board each Fiscal Year from 2002/2003 through 2014/2015 (Attachment C), in compliance with California Government Code §66006.
