DEPARTMENT RECOMMENDATION
At their meeting of August 8, 2017 (Item 23) the Board approved Ordinance 5056 and set a public hearing for Final Passage (Second Reading) on August 15, 2017. Community Development Services, Department of Transportation (Transportation), recommends that the Board approve the Ordinance delegating authority to the Director of Transportation to acquire real property of $25,000 or less.
DISCUSSION / BACKGROUND
On June 27, 2017 (Item 30), the Board reviewed and authorized Transportation to proceed with preparation of a proposed new Ordinance delegating to the Director of Transportation the authority to acquire real property, with authority limited to acquisitions of $25,000 or less.
If approved, upon effective date of new ordinance, Ordinance 5037, which delegated certain right of way acquisition authority to the Director of the Community Development Agency, will be repealed and of no further effect. Transportation will continue to provide reports to the Board on the purchase of properties of $25,000 or less.
ALTERNATIVES
The Board could choose to not approve delegated signatory and negotiating authority to the Director of Transportation. Approval of right of way acquisition documents will be performed by the Chief Administrative Officer or his or her designee.
OTHER DEPARTMENT / AGENCY INVOLVEMENT
County Counsel has reviewed and approved the proposed new ordinance.
