Title: Health and Human Services Agency (HHSA), recommending the Board: 1) Approve the use of the Registered Dietitian agreement, attached hereto as Attachment B, on an “as needed” basis pursuant to requirements established by the funder, California Department of Aging; and 2) Adopt and authorize the Chair to sign Resolution 156-2017, thereby delegating authority to the HHSA Director, or designee, to execute and administer Registered Dietitian agreements using Exhibit A to said Resolution. DEPARTMENT RECOMMENDATION:
Health and Human Services Agency (HHSA) recommending the Board approve the use of the Registered Dietitian agreement (Template) and adopt the Resolution authorizing the HHSA Director, or designee, to execute agreements using said Template on an “as needed” basis.

On March 28, 2017, HHSA received an inquiry from California Department of Aging (CDA), requesting that we revise the current Registered Dietitian agreement to incorporate specific requirements. A draft agreement was developed, approved by Counsel and Risk, and approved by CDA as meeting the requirements of the funding terms and conditions. HHSA is recommending the Board approve this Registered Dietitian template to ensure compliance with funding requirements in the future.

Additionally, HHSA has determined that services provided under the Template satisfy the criteria defined in Chapter 3.13, Section 3.13.030 of the County Ordinance in that the work performed in accordance with CDA’s requirements is on an “as needed” basis; therefore, it is more economical and feasible to engage an independent contractor for registered dietitian services.
