DEPARTMENT RECOMMENDATION

Community Development Services, Planning and Building Department (Planning), recommending the Board approve and authorize the Chair to sign the First Amendment (Amendment 1) to Agreement for Services 442-S1710 (Agreement) with Kimley-Horn and Associates, Inc. (KHA), amending the Scope of Work and increasing the not-to-exceed amount of $51,670 by $38,875, without a change in rates, for a total not-to-exceed amount of $90,545, and further, adding subconsultant language and necessary administrative changes, for updating the County's Traffic Impact Mitigation (TIM) Fee Program. 

 

DISCUSSION / BACKGROUND

On May 12, 2017, the original KHA Agreement (Attachment A) was approved by the Purchasing Agent to provide the necessary expertise to assist Planning staff with the update to the TIM Fee Program, as required by the adopted 2004 General Plan.  The original Scope of Work included calculation of updated service volumes, a deficiency analysis, TIM Fee scenario analysis, recommended TIM Fee improvements, a presentation to the Board, and an update of the 2015 parcel map data. 

 

On December 12, 2017 (Item 26), the Board directed staff to expedite the preparation of an amendment to the KHA Agreement, to amend the original Scope of Work to include the preparation of an addendum to the County’s Programmatic Environmental Impact Report (EIR) for the Western Slope Roadway Capital Improvement Program (CIP) and TIM Fee Program Update.  The proposed Amendment 1 provides consultant assistance to allow staff to move forward with a Technical Update, including moving of parcels in Zone 2 into Zone 8.  The Board directed staff to return with the Update by the end of March 2018.

 

The work to update the service volumes and the deficiency analysis is related to updating the TIM Fee Program, to be consistent with the latest Highway Capacity Manual (HCM6) methodology.  The following Tasks and Items of Work have been added to the original Scope of Work and are listed in the attached Scope of Work Amendment (Attachment C).

 

Amended Task 6 - Additional Effort for Parcel Map Updates ($12,000 was added to the original amount for Task 6)

Additional funds are being requested to complete the original Task 6 - Parcel Map Updates.  The original Scope of Work did not adequately cover the work needed to complete the Updates to the parcel map database.

 

Added Task 8 - Preparation of an Addendum to the El Dorado County Western Slope Roadway CIP-TIM Fee Program Update EIR ($10,000)

The updated deficiency analysis resulted in the addition of projects for inclusion in the TIM Fee Program.  The new projects require an update to the County’s existing Programmatic EIR for the Major Five-Year CIP and TIM Fee Program, which was not included in the original Scope of Work.

 

A sub-consultant will be preparing the "Addendum to the County Western Slope Roadway CIP-TIM Fee Program Update EIR for El Dorado County." It  will analyze four additional capital improvement projects that may be added to the CIP list that were not analyzed in the existing EIR certified in 2016. These four capital improvement projects consist of either widening or adding pull outs in lieu of widening. In accordance with Section 15164 of the California Environmental Quality Act (CEQA) Guidelines, a lead agency may prepare an addendum to a previously certified EIR if some changes or additions are necessary but none of the conditions described in Section 15162 calling for preparation of a subsequent EIR have occurred. It is assumed that updating the CIP list would not result in new or substantially increased significant impacts and that, pursuant to CEQA Guidelines Section 15164, an EIR Addendum would be the appropriate level of supplemental CEQA review.

 

 Added Task 9 - Vehicle Pullout Analysis for State Route (SR) 193 and SR 49 ($12,000)

The updated deficiency analysis identifies roadway segments on SR 193, between Georgetown and Cool, in addition to the SR 49 road segments in and around the State Park, as not meeting the General Plan requirement for Level of Service (LOS) D in the rural regions.  This analysis will determine if a smaller project can be identified for the segments that will meet the LOS requirement without resorting to four-lane facilities.  This was not included in the original Scope of Work.

 

Added Task 10 - U.S. Highway 50 (U.S. 50) Merge/Diverge Analysis ($4,875)

A merge/diverge weaving analysis for U.S. 50, between the County-line and the Ponderosa Interchange, will be performed to provide additional support for the inclusion of the auxiliary lanes specified in the El Dorado Hills Blvd. Interchange Project Study Report/Project Report, the Silva Valley Interchange Project Study Report/Project Report, the Cameron Park Drive Interchange Project Study Report and the Ponderosa Drive Interchange Project Study Report.  This was not included in the original Scope of Work.

 

ALTERNATIVES

The Board could decide to not update the County's TIM Fee Program, or the Board could decide to not expedite the update to the County's TIM Fee Program

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

The proposed Amendment 1 has been approved by County Counsel and Risk Management.

 

CAO RECOMMENDATION

 It is recommended that the Board approve this item.

 

 FINANCIAL IMPACT

There is no change to Net County Cost associated with this item.  Sufficient appropriations have been included in the Fiscal Year 2017/18 Budget and will be recommended in future budgets for the term of the Agreement.

1) Clerk of the Board to obtain the Chair’s signature on the two (2) original copies of Amendment 1.

2) Clerk of the Board to return one (1) fully executed original copy of Amendment 1 to the Community Development Services, Planning and Building Department, attention of Cindy Johnson.
