DEPARTMENT RECOMMENDATION

Community Development Services, Department of Transportation (Transportation), recommending the Board receive and file a biannual report on real property acquisitions executed by the Chief Administrative Officer or his or her designee, under the authority of Ordinance 5051, and by the Director of Transportation, under the authority of Ordinance 5056, for acquisitions totalling $65,750 during the reporting period of May 18 through November 20, 2017.

 

DISCUSSION / BACKGROUND

On April 5, 2016 (Item 23), the Board approved Ordinance 5037 which delegated to the Community Development Agency Director the authority to acquire any interest in or easement upon real property for the purposes of a public structure, road, trail, or improvement as previously approved by the Board or as part of the approved Capital Improvement Program, with the delegated authority limited to real property acquisitions of $25,000 or less in value.  This Ordinance became effective on May 5, 2016.  

 

Section 1B, Item 5, of Ordinance 5037 required a biannual report to the Board on real property acquisitions executed under the authority of this Ordinance by the Community Development Agency Director.  In compliance with this Section, two biannual reports were provided to the Board, one on January 24, 2017 (Item 23) and one on August 8, 2017 (Item 18).  For these two biannual reporting periods, only real property acquisitions for approved capital improvement projects were executed.

 

On April 18, 2017 (Item 6), the Board approved Ordinance 5051 thereby reorganizing the Community Development Agency and delegating signature authority from the Community Development Agency Director to the Chief Administrative Officer or his or her designee.  The Ordinance became effective on May 18, 2017.

 

On August 15, 2017 (Item 13), the Board approved Ordinance 5056 which delegated to the Director of Transportation the authority to acquire any interest in or easement upon real property for the purposes of a public structure, road, trail, or improvement as previously approved by the Board or as part of the approved Capital Improvement Program, with the delegated authority limited to real property acquisitions of $25,000 or less in value.  This Ordinance became effective on September 14, 2017, and upon this effective date, Ordinance 5037 was repealed and of no further effect.

 

Section 1B, Item 5, of Ordinance 5056 also requires a biannual report to the Board on real property acquisitions executed under the authority of this Ordinance by the Director of Transportation.  This represents the first biannual report of real property acquisitions pursuant to this Section directive.  For this biannual reporting period of May 18 through November 20, 2017, only real property acquisitions for approved capital improvement projects have been executed.

 

During this six-month period, the Transportation Right of Way Unit acquired 26 individual parcels for a total cost of $65,750, ranging from $1,000 to $13,200 per acquisition, with documents signed by either the Chief Administrative Officer or his or her designee, or the Director of Transportation.  Please refer to Attachment 3A for the current biannual report which provides an itemization of how much each individual parcel or easement cost, the purpose of the acquisition, how it was funded, and the associated capital project.
