DEPARTMENT RECOMMENDATION

Community Development Services, Environmental Management Department (Environmental Management), recommending the Board consider the following:

1) Accept a payment program award in the amount of $52,268 through the State of California, Department of Resources Recycling and Recovery (CalRecycle), Used Oil Payment Program (Payment Program), Cycle 8 (OPP8), Fiscal Year 2017-18, for the term of July 1, 2017 through June 30, 2019; and

2) Delegate authority to the Environmental Management Director, or designee, to execute all payment program related documents, but not including amount or term, including, but not limited to, requests for payments, reports, and all associated documents necessary to secure the payment program funds and implement the program.

 

DISCUSSION / BACKGROUND

Pursuant to Public Resources Code section 48600 of the California Oil Recycling Enhancement Act, the State of California, as administered by CalRecycle, provides a maximum of $11 million per fiscal year in payments to local governments for implementation of local used oil and filter collection programs. The payment amounts awarded though this Payment Program are calculated on a per capita basis using the State of California, Department of Finance’s population statistics.

 

CalRecycle administers various payment programs and grants, and provides oversight for California’s waste handling and recycling programs, which are managed at the local level by cities and counties. CalRecycle’s procedures for administering payment programs and grant applications require the applicant’s governing body to declare by resolution certain authorizations related to the administration of these funds. The Board’s acceptance of the funds under this Payment Program will ensure Environmental Management is able to contribute to the promotion of used oil and used oil filter collection and recycling programs at the local level.

 

Eligible costs using funds under this Payment Program include, but are not limited to:

                     Establishing, maintaining and/or enhancing used oil and used oil filter collection/recycling programs;

                     Developing educational materials informing the public about used oil and used oil filter collection and recycling;

                     Purchasing or renting storage facilities dedicated to oil-related activities and supplies;

                     Specific training; and

                     Developing and purchasing used oil program materials. 

 

On June 28, 2017, Environmental Management submitted an application to CalRecycle for this Payment Program (Attachment C). On November 8, 2017, notification was received from CalRecycle advising the award of the Payment Program in the amount of $52,268 for Cycle 8 of the Payment Program, with a term of July 1, 2017 through June 30, 2019 (Attachment D). 

 

In order to achieve the goals established for this Payment Program, Environmental Management intends to use the awarded funds for the following items:

                     Provide public education and outreach regarding used oil storage, disposal, and handling;

                     Purchase materials to provide to the public to promote proper collection of used oil;

                     Install, remove, or update used oil collection sites within the County;

                     Provide funding for employees to work household hazardous waste events where used oil is collected, events at the El Dorado County Fairgrounds speedway, and events at various marinas within the County; and

                     Fund the disposal of used oil and used oil filters collected within the County.

 

In accordance with Board of Supervisors Policy A-6, the Board is the sole authority for accepting grant awards and approving grant agreements. After acceptance of a grant award and approval of the grant agreement, the Board may delegate authority to execute all documents, including, but not limited to, the grant funding agreement, amendments, request for payment, reports, and all other associated documents necessary to secure and implement the approved grant payment program.

 

The recommended acceptance of these funds authorizes the Director of Environmental Management, or designee, to execute all reports and associated documents necessary to secure and expend the funds for the purpose of implementing this Payment Program. Environmental Management will continue to obtain Board approval for the acceptance of all funds pursuant to Board Policy A-6.

 

ALTERNATIVES

The Board could reject the acceptance of the Payment Program funds. This would result in the forfeiture of available Payment Program funds to the County and would further inhibit Environmental Management’s ability to promote used oil and used oil filter collection and recycling programs to the residents of the County.

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

County Counsel has reviewed and approved the Payment Program Guidelines for Cycle 8 (Attachment B).

 

CAO RECOMMENDATION

 It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

There is no change in Net County Cost.  No matching funds are required for this Payment Program.
