Fiscal Impact/Change to Net County Cost:
Funding for the Project will come from the TIM fee program, STIP funds, SHOPP funds, and MC & FP funds. There is no net cost to the County General Fund associated with this agenda item.

Background:
On January 30, 2007, your Board approved the Acquisition Agreement for Public Purposes (Acquisition Agreement) to enable the acquisition of land rights affecting portions of the Prospector's Plaza, owned by WRI Golden State LLC. The land rights acquired included fee and easements, in order to widen Missouri Flat Road and allow for the reconstruction/expansion of the westbound on-ramp onto U.S. Highway 50 from Missouri Flat Road. These acquired land rights were for Phase 1A and Phase 1B of the project, and Phase 1A of the project has been completed. Also included in the Acquistion Agreement was a provision for the relocation of the TOMRA recycling center; the excerpted pages from the Acquisition Agreement related to the relocation are shown on Attachment D.

In Phase 1B of the project, the TOMRA Recycling Center, which is currently located in the parking lot of the KMart store and adjacent to the current U.S. Hwy. 50 westbound on-ramp, will have to be temporarily relocated to allow for the construction ...
