Title

1) Approve and authorize the Chair to sign Agreement for Services 3132 with Nelson S. Jacinto doing business as Grace Home II, a licensed residential care facility for the elderly, for a three-year term to begin upon execution, with a maximum contractual obligation of $220,000; and

2) Authorize the Purchasing Agent, or designee, to execute further documents relating to Agreement for Services 3132, including amendments which do not increase the maximum dollar amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management.

 

FUNDING:   Mental Health Services Act, Medi-Cal, and Mental Health Realignment.

DEPARTMENT RECOMMENDATION: 

Health and Human Services Agency (HHSA) recommending the Board approve and authorize the Chair to sign Agreement for Services 3132 to provide supplemental residential care treatment and services for adults with serious mental illness on an “as requested” basis.

 

Additionally, County does not possess the facilities or personnel for adult residential treatment and has determined, in accordance with County Ordinance Section 3.13.030, it is more economical and feasible to engage an independent contractor for these services. 

 

DISCUSSION / BACKGROUND:

On May 9, 2017, the Board of Supervisors approved Agreement 485-S1711, with Danilo and Gloria Ibanez, doing business as (dba) Grace Home (File ID: 17-0428: Agenda No.15) for a term June 1, 2017 through September 30, 2020.  In May 2018, HHSA received notice that the Ibanez’s were in the process of transferring ownership to Nelson S. Jacinto, dba Grace Home II.

 

Upon execution of Agreement 3132 with Nelson S. Jacinto, the Agreement 485-S1711 with Danilo and Gloria Ibanez will be terminated.  

 

HHSA contracts with the State to serve as the Mental Health Plan (MHP) for the County.  As a result of a shortage of residential beds throughout the State, HHSA, as the MHP, contracts with as many long-term residential treatment facilities as possible in order to ensure capacity and availability of services on an “as needed” basis.

 

Grace Home II is licensed as a Residential Care Facility for the Elderly by the State of California to provide twenty-four (24) hour care and rehabilitation services designed to assist clients with mental disorders.  HHSA does not have long-term residential facilities and must contract for these services.  Services are provided on an “as requested” basis. 

 

ALTERNATIVES:

Disapproval of Agreement for Services 3132 will result in disruption of housing, treatment and services for the clients currently placed in that facility.  In addition, the County’s capacity to provide long-term residential care would be diminished.

CAO RECOMMENDATION:

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT:

There is no Net County Cost associated with this Agenda item.  Sufficient appropriations were included in the fiscal year 18-19 budget, and will be included in future budgets for the term of the Agreement

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain signature of Chair on two (2) original Agreements for Services 3132.

2) Clerk of the Board to return one (1) fully executed Agreement to HHSA Contracts Unit at 3057 Briw Road.
