DEPARTMENT RECOMMENDATION
Community Development Services, Department of Transportation (Transportation), recommending the Board approve and authorize the Chair to sign Agreement for Services 3171 (Agreement) with Aptim Environmental & Infrastructure, Inc. (Aptim), for a not-to-exceed amount of $300,000, to provide the environmental remediation for the Diamond Springs Parkway Phase 1B Project (Project), Capital Improvement Program (CIP) 72334 / 36105011, for a term commencing upon execution by both parties and expiring three years thereafter.
Transportation recommends the Board make findings in accordance with Section 3.13.030 of the County Ordinance Code that it is more economical and feasible to engage an independent consultant for environmental remediation of the former lime plant site that is located within the Project’s footprint.
There are specialty skills required for the work to be performed under this Agreement that are not expressly identified in County classifications. The level of work is too infrequent to warrant hiring new employees. The independent consultant will serve as short term, highly specialized staff support on the very critical and time sensitive Project.
DISCUSSION / BACKGROUND
In January 2018, at the request of Transportation, the Procurement and Contracts Division of the Chief Administrative Office issued the Request for Proposal (RFP) for an engineering consultant for the environmental remediation of the former lime plant site on the Project. The Project includes a proposed 4-lane arterial road that will connect Missouri Flat Road and State Route 49 near the community of Diamond Springs. A portion of the Project will be constructed on the site of a former lime plant in which there are recognized environmental conditions. Residual lime materials exist at various depths within the site and are currently contributing to storm water runoff with elevated pH levels.
The County received four (4) proposals for the RFP and following evaluation by Transportation staff, Aptim was determined to have the qualified staff and experience to assist Transportation with the environmental remediation services.
On May 15, 2018 (Item 16), the Board awarded the RFP to Aptim and directed Transportation to return to the Board with a proposed contract for services following negotiations.
The RFP process was conducted in accordance with County Procurement Policy C-17. The El Dorado County Employees Association, Local 1, was informed of this proposed Agreement.
ALTERNATIVES
1) The Board could direct Transportation to make changes to the proposed Agreement and return to the Board at a later date. Transportation's ability to move forward on the Project would be delayed.
2) The Board could direct Transportation to complete the requested services through an alternate agreement. This option would also result in delayed completion of the Project and potential additional costs.
3) Transportation could attempt to hire additional staff for a short period of time (part time, limited term). However, it is not likely that someone with the necessary environmental remediation expertise would be willing to work part time in a limited term capacity.

FINANCIAL IMPACT
There is no change to net County cost resulting from approval of the proposed Agreement. Funding for the Project is included in Transportation’s 2018 CIP, which was approved by the Board on June 26, 2018 (Item 61).
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair’s signature on two (2) originals of the Agreement.
2) The Clerk of the Board will forward one (1) fully-executed original of the Agreement to Community Development Services, Administration and Finance Division, Contracts and Procurement Unit, for further processing.
