Department of Transportation recommending the Board:
1) Make findings in accordance with Section 3.13.030 of the County Ordinance that it is more economical and feasible to engage an independent contractor for on-call materials testing services; and
2) Approve and authorize the Chair to sign Agreement for Services 3498 with Geocon Consultants, Inc. to provide on-call materials testing services in the not-to-exceed amount of $110,000 for a period beginning upon execution and expiring three years thereafter.
FUNDING: Various funding sources as detailed in the Department of Transportation’s Capital Improvement Program, including federal, state, and local funding.

DISCUSSION / BACKGROUND
In October 2018, Department of Transportation (Transportation) issued an informal Request for Proposal (RFP) for on-call materials testing services. Transportation has a materials testing lab that can perform the majority of the testing needed for construction projects; however, there are some specialized tests which they cannot perform and must be sent out to a consultant. Three (3) proposals were received and evaluated and Geocon Consultants, Inc. was selected as the most qualified firm.
Transportation recommends the Board make findings in accordance with Section 3.13.030 of the El Dorado County Ordinance that it is more economical and feasible to engage an independent contractor for on-call materials testing services because there are specialty skills and equipment required for the work to be performed under this agreement which are not sufficient to warrant the addition of permanent staff or the purchase of expensive equipment.
The El Dorado County Employees Association (Local #1) was informed of the proposed Agreement.
ALTERNATIVES
The Board could choose to not approve the agreement. Transportation would make changes as requested and return to the Board for approval.

FINANCIAL IMPACT
Funding for the Agreement will be provided by various CIP project funding sources, including federal, state, and local funds. The funds for this contract are budgeted and will be budgeted in future years. The services are used on a as needed basis. The proposed action results in no change to net County cost.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair’s signature on two (2) originals of the Agreement.
2) The Clerk of the Board will forward one (1) fully-executed original of the Agreement to Community Development Services, Administration and Finance Division, Contracts and Procurement Unit, for further processing.
