DISCUSSION / BACKGROUND

The Superior Court of California, County of El Dorado, first applied for the California Collaborative Justice Courts Substance Abuse Focus Grant Program (SAFG) in August of 2014. The grant is funded through the Judicial Council of California.  The Court received notification of the grant award in late 2014 under the terms and conditions of Contract No. 1029398. A second year application (FY 2015-2016) was submitted and awarded in August 2015 under the terms and conditions of Contract No. 1031075. A third year application (FY 2016-2017) was submitted and awarded in August 2016 under the terms and conditions of Contract No. 1032705. A fourth year application (FY 2017-2018) was submitted and awarded in October 2017 under the terms and conditions of Contract No. 1035004.  A fifth year application (FY 2018-2019) was submitted and awarded in October 2018 in the amount of $14,000.00.

 

The grant program was designed to promote innovation in collaborative justice courts developed to address complex community problems that are exacerbated by substance abuse related offenses.  The program is also designed to assist Courts in using drug court principles and substance abuse treatment in the context of collaborative justice courts. The Probation Department’s participation in this grant program will be to provide Court services to complete the program objectives identified in the MOU.  This MOU, if adopted, will cover the grant term of July 1, 2018, through August 31, 2019.  The previous MOU was for a term of July 1, 2017 through November 30, 2018. 

 

Due to the timelines of the State budget process, the grant funds are awarded on a retroactive basis.  The term of the previous MOU did not align with the grant funding and is therefore being corrected in the term of this MOU.  As a result, staff is requesting approval of this retroactive MOU.  The Probation Department has submitted a claim for reimbursement under this grant award in the amount of $2,974.00 for monitoring services rendered and testing supplies received in September and October 2018; furthermore, the Probation Department anticipates expending the full grant award of $14,000.00 during the term of this MOU.

 

ALTERNATIVES

If this MOU is not adopted these services will be provided for out of the general fund.

FINANCIAL IMPACT

No change to Net County Cost.  State funding will reimburse Probation for the actual cost of continuous alcohol monitoring provided for in the attached MOU.
