DISCUSSION / BACKGROUND

The Henningsen Lotus Park Conceptual Plan was adopted on December 13, 2016 (Legistar #16-1219).  The Plan identified riverbank stabilization and restoration as a Tier I priority.  In January 2017, the park flooded resulting in damage to the riverbank adjacent to Henningsen Lotus Park.

 

The Department of Transportation (DOT) has extensive experience working on  FEMA projects, and entered into discussion with Cal OES on the Parks Division’s behalf in January 2019. Cal OES extended the Notification of Obligation and payment expiration date to March 31, 2019, however, another time extension will be needed to complete this project. Funding for the County match, estimated at $23,125, as well as $15,000 for DOT staff time is needed to complete the project.

As DOT will need to request another time extension from FEMA and no FEMA funding has been approved as of this date, no budget transfer is being submitted at this time. DOT will not begin any billable work without FEMA and Cal OES written authorization of the scope of work and notification of eligibility for funding reimbursement.

Staff would have to find other funding to complete this project or the project would not be completed.

CAO RECOMMENDATION / COMMENTS

It is recommended that the Board approve Transportation's request for an extension from FEMA and the conceptual approval of the funding requests.

 

FINANCIAL IMPACT

With an extension granted by FEMA, this project is eligible for 75% reimbursement by FEMA and 18.75% reimbursement by California Office of Emergency Services.  The remaining 6.25% is local discretionary funding.  With Board approval, Transportation and the Parks Division will continue working with these agencies to obtain the maximum allowable reimbursement. The estimated cost to the County is $38,125, to be paid from the Henningsen Lotus Park Trust. If the extension is granted, the Parks Division will return to the Board with a request for a budget transfer.
