2) Adopt and authorize the Chair to sign Resolution

DISCUSSION/BACKGROUND

The US 50/Camino Area Safety Project CIP 71319/36104015 (Project) is slated to improve access and reduce accidents in Camino along US 50. Construction of the Project is currently scheduled to begin in FY19/20.

 

The Project consists of construction of a median barrier, undercrossing, and traffic mitigation improvements on US 50. Agency responsibilities of construction of the Project are addressed in Cooperative Agreement 03-0638 (Agreement) between the California Department of Transportation (Caltrans) and the County of El Dorado, which was approved by the Board on April 2, 2019 (Item 29). Per Agreement, Caltrans is the Right of Way Implementing Agency and will be acquiring right of way interests.

 

A portion of Pondorado Road in Camino is needed for road right of way for the Project. This portion has previously been offered to the County as Irrevocable Offer of Dedication 2007-07 (IOD). On April 17, 2007 (Item 8), the Board adopted Resolution 084-2007, which acknowledged, but rejected at the time, the IOD from Nikolay and Susanne Demidoff for road right of way and public utilities easement purposes on Assessor’s Parcel Number 048-471-28. The IOD was a condition of approval for Design Review DR05-0024. The Design Review was for the construction of banquet facilities and associated improvements on the Demidoff’s Parcel.

 

The IOD identified two offers for potential future acceptance:

1) Road right of way, along Pondorado Road, as described and depicted in Exhibits A-1 and B-1 of Attachment C of this item; and

2) Road right of way and public utilities easement, along Golden Chain Road, as described and depicted in Exhibits A-2 and B-2 of Attachment C of this item.

 

Transportation has reviewed the IOD and recommends the Board adopt the Resolution accepting only the offer of road right of way on Pondorado Road, as described and depicted in Exhibits A-1 and B-1 of Attachment C of this item, and authorize the Chair to sign the Certificate of Acceptance.

 

Sierra Blanca Drive, which is immediately to the west of Pondorado Road, is currently part of the County Maintained Mileage System. Sierra Blanca Drive, along with Pondorado Road and its proposed extension, will become a frontage road to the Project. Acceptance of the road right of way on Pondorado Road will serve multiple parcels associated with the proposed Project, and should be entered into the County Maintained Mileage System.

 

ALTERNATIVES

If the Board chooses not to accept the Pondorado Road portion of the IOD, the Project may need to be redesigned or may not proceed at all. A preliminary study completed and approved by Caltrans in 2010 looked at alternatives and recommended limiting at grade crossings, improved parallel capacity, and suggested extending Pondorado Road north to a future US 50 undercrossing.

 

The right of way for the Project acquired by Caltrans will be relinquished to the County after completion of construction. If the road right of way along Pondorado Road is not entered into the Maintained Mileage System, the future frontage road to the Project will have approximately 375 feet which is not County maintained, with County maintained roadway on either side.

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair’s signature on one (1) original of the Resolution and Certificate of Acceptance pertaining to Nikolay and Susanne M. Demidoff and APN 048-471-28.

2) The Clerk of the Board will obtain the Chair's signature on one (1) original of the Resolution to accept into the County's Maintained Mileage System the portion of Pondorado Road described in the Irrevocable Offer of Dedication.

3) The Clerk of the Board will forward the authorized documents for recording to the County Recorder’s Office.

4) The Clerk of the Board will forward one (1) copy of the executed documents to Transportation, attn: Jackie Cook, for further processing.
