Transportation Department recommending the Board authorize the Chairman to sign the following Amendments with California Tahoe Conservancy:
1) Amendment 1 to Agreement CTA 04019 for Monterey Estates Erosion Control Projects;
2) Amendment 1 to Agreement  CTA 04028 for the Angora Creek Fisheries and Cold Creek Fisheries Enhancement Projects; and
3) Amendment 1 to Agreement CTA 04036 for Christmas Valley Phase 1 Stream Environment Zone Project.

Fiscal Impact/Change to Net County Cost:  
There is no Fiscal Impact associated with this agenda item.  There is no net cost to the County General Fund associated with this agenda item.
 
Background:
On December 17, 2008 the Department of Transportation (Department) was notified by the State of California (State), via the CTC, that the State was freezing existing bonds effectively stopping or significantly slowing work on a number of State funded Environmental Improvement Program (EIP) Projects from December 17, 2008 to present.  On July 9, 2009, the CTC notified the Department that the State Treasurer's Office freed up limited funds to cover existing unpaid bills with the remaining amount used to restart existing bond-funded projects.  At that time, the CTC requested a restart funding strategy from the Department to account for the fact that the released funds are less than the full cost of the existing grants.  The Department submitted the funding strategy to the CTC on August 19, 2009.   
 
Reason for Recommendation:
The Amendment of these Agreements will allow the Department to commence work on the respective EIP Projects and will reinstate $174,281.53 in grant funds that would have expired June 30, 2009.  The Amendments will extend the life of the Agreements to June 30, 2011.  Following is a brief synopsis of each Project:
 
1. CTA-04019 is a planning grant for the Montgomery Estates Erosion Control Projects.
 
2. CTA-04028 is a planning grant for the Angora Creek Fisheries and Cold Creek Fisheries Enhancement Projects.
 
3. CTA-04036 is a planning grant for the Christmas Valley Phase 1 Stream Environment Zone Project that the Department intends to shift to the Christmas Valley Phase 2 Erosion Control Project.   
 
Action to be taken following Board approval:
1) Board Clerk will obtain the Chairman's signature on the five (5) originals of each subject grant Amendment.
2) Board Clerk will forward the originals to the Department for further processing to the CTC.
3) Following final processing, the CTC will transmit one (1) fully-executed original to Board Clerk for each Amendment.
4) Upon receiving the originals, Board Clerk will forward a copy of each Amendment to the Department for its files.
