Probation Department recommending the Board consider the following:
1) Approve and authorize the Chair to sign Amendment II to Revenue Agreement 4365 with County of Alpine, Amendment II to Revenue Agreement 5849 with County of Amador, Amendment I to Revenue Agreement 5851 with County of Inyo, and Amendment I to Revenue Agreement 5852 with County of Mono, to:
a) Amend the contracts to change all references of the word "ward" to "youth;”
b) Amend the contracts to increase the rate to $350 per day, $400 per day for Commitment Programming; and $475 per day for the Secure Track Program; and
c) Amend the contracts to include verbiage to define rates for youth held less than twenty-four hours; and
2) Approve and authorize the Chair to sign Amendment I to Revenue Agreement 5935 with County of Modoc to:
a) Amend the contract to increase the rate to $350 per day, $400 per day for Commitment Programming; and $475 per day for the Secure Track Program; and
b) Amend the contract to include verbiage to define rates for youth held less than twenty-four hours.

DISCUSSION / BACKGROUND
At present, the County of El Dorado has one established Juvenile Detention Facility (JDF), the Juvenile Treatment Center in South Lake Tahoe, for the temporary or long-term commitment of minors detained in accordance with the provisions of the California Welfare and Institutions Code.
Currently, the Counties of Alpine, Amador, Inyo, Modoc, and Mono have the right to place youth of their juvenile court in the County of El Dorado JDF. Amendments to each County’s respective agreements will, as needed:
1) Update the term "ward" to "youth," as youth is the appropriate term to utilize pursuant to regulation and law;
2) Increase the non-reserved, per day, per youth rate to $350; the per day, per youth ordered to the Juvenile Detention Facility Commitment Programming rate to $400; and the per day, per youth ordered to the Juvenile Detention Facility Secure Track Program rate to $475; and
3) Define partial day rates as youth held for twelve (12) hours or less shall be charged one-half (1/2) the respective daily rate; youth held over twelve (12) but up to twenty-four (24) hours shall be charged the respective full daily rate.
Daily rates are being substantially increased due to the signing of SB 823 (Juvenile Justice Realignment: Office of Youth and Community Restoration) on September 30, 2020. Under SB 823, the Division of Juvenile Justice (DJJ) intake closed for most youth on July 1, 2021, and California counties became fully responsible for housing, programming, and treatment of youth previously eligible and appropriate for DJJ.
Rates were determined by establishing a base daily rate and then estimating additional costs for increased programming for the Commitment and Secure Track Programs. SB 823 funding provided to all California counties, regardless of if they operate a juvenile facility, was the basis for the estimated daily rates. Additionally, rates need to be modified taking into consideration the base cost of operating a facility, regardless of the number of youth housed. As the facility population increases, average base costs will decrease. Daily costs per youth will be variable, but fixed costs remain relatively constant.
Alpine and Amador require that their Counties’ signatures be the final ones on the Amendments. Probation respectfully requests the El Dorado County Board of Supervisors to allow the Chair to sign those Amendments prior to Alpine and Amador Counties.
