Fiscal Impact/Change to Net County Cost:   There is no Net County Cost associated with this funding Agreement with CalEMA.  
 
Background:   On January 19, 2010, the Board ratified the Health Services Department Director's signature on an application for funding through CalEMA (Agenda Item #6, Legistar File #09-1538). This application for one-time Recovery Act funds being distributed through CalEMA and the California Alcohol and Drug Program was accepted and approved by CalEMA, with a letter indicating grant award received by the Department May 19, 2010 (Attachment B). Although the original Board item on January 19, 2010 anticipated that the Department would return to the Board for signature on a funding Agreement, no such document was ever provided by CalEMA; instead they simply sent the aforementioned letter of award.
 
In mid-December 2010, counties that had been awarded ARRA funding received informal notice that CalEMA would be offering a six-month extension of the grant term to allow counties to continue spending any remaining funds provided by the grants.  In mid-January, the Department received documentation from CalEMA (Attachment C) indicating that a no-cost extension of the grant term would be approved, provided said documents were signed by the official authorized to sign the grant (i.e., HSD Director, as ratified by the Board on January 19, 2010) and returned to CalEMA no later than January 31, 2011.
 
The Department and County Counsel worked together to expedite review and processing of the extension documents to meet the required deadline. Due to the extremely short notice, the Department was unable to bring this item to the Board prior to the deadline.  In view of this, the Department Director signed the extension documents (as her signature had been approved by the Board on January 19, 2010 as the "official authorized to sign" the application) and we are now returning for ratification of this action.
 
Compensation for Services:   Monthly itemized invoices submitted quarterly for reimbursement of allowable expenses in accordance with grant terms and conditions.
Contract Termination:  This Agreement may be cancelled by CalEMA for failure to conform to the terms and conditions of the Agreement, and/or in the event funding is reduced or eliminated for this project.
Reason for Recommendation:   Approval of this extension to the CalEMA grant will allow the Department to continue providing substance abuse treatment for criminal offenders convicted of nonviolent drug offenses in the Offender Treatment Program (OTP) in conjunction with a drug court model.
Action to be taken following Board approval:
A copy of the Board minutes shall be submitted to CalEMA by the Department, demonstrating Board authorization of grant extension and ratification of the Health Services Director's signature on said extension documents.
