Acquisition costs are $1,500 with title and escrow fees estimated at $1,500 for a total estimated cost of $3,000.  Funding for the acquisition process will be provided by California Tahoe Conservancy grant funds and Tahoe Regional Planning Agency Mitigation Funds.
 
Background
The Department of Transportation (Department) is working to advance the Sawmill 2B Bike Path and Erosion Control Project (Project), which will construct a new bike path and multi-use trail along the south side of Sawmill Road that will connect to the County's Sawmill 1 Bike Path Project (CIP No. 95148) completed in 2008 and to the County's Sawmill 2A Bike Path and Erosion Control Project (CIP No. 95165) completed in summer 2012.  The Project will design and implement erosion control and water quality improvement measures, reducing the discharge of sediment and pollutants into Lake Tahoe, as well as construct a multi-use path for recreational purposes along Sawmill Road.
 
The Project is subject to the California Environmental Quality Act (CEQA).  The CEQA Mitigated Negative Declaration was approved by the Board on December 10, 2009.
 
On June 2, 2009, the Board authorized the Department to proceed with the acquisition process for the land rights necessary for the construction and completion of the Project.
 
Reason for Recommendation
Negotiations have concluded with the property owners, Matthew M. Mikkelsen and Karen I. Mikkelsen, Husband and Wife and Tyler M. Mikkelsen, All As Joint Tenants, and a settlement has been reached that is representative of the appraised value of the necessary land rights.
 
Action(s) to be taken following Board approval
1. The Acting Clerk of the Board will obtain the Chair's signature on the Easement Acquisition Agreement and the Certificates of Acceptance for the Grant of Drainage Easement and the Grant of Temporary Construction Easement.
2. The Acting Clerk of the Board will return all executed documents to the Department for final processing.
