Background
On February 7, 2012, County Counsel recommended a hearing to consider the best course of action that met the needs and interests of the County with regard to the West Valley Village Subdivision Improvement Agreements, Units 1B (AGMT #07-1493), 3A (AGMT #07-1459), 3B (AGMT #07-1467), 4 (AGMT #07-1458), 5A (AGMT #07-1466), 6A (AGMT #07-1457), 6B (AGMT #07-1494), 6C (AGMT #07-1495), and 7B (AGMT #07-1496) (Collectively the "Subdivision Improvement Agreements"), which were outside the performance period contained in the Subdivision Improvement Agreements.
At this hearing the Board directed staff to return to the Board with amendments to the Subdivision Improvement Agreements that 1) extend the Subdivision Improvement Agreements performance period one year from the Board hearing date (extend until 02/07/13), and 2) provide updated Engineer's Estimates and Surety Riders.
Transportation staff completed the updates to the Engineer's Estimates for each Subdivision Improvement Agreement Unit in coordination with the Owners Registered Civil Engineer and provided the Subdivision Improvement Agreement Amendments to the owners/developers for review, signature, and surety processing in accordance with Board direction.
Reason for Recommendation
The Amendments to the Subdivision Improvement Agreements were provided to the Department signed and notarized by each respective owner/developer with associated updated Engineer's Estimates and associated Performance and Laborers and Materialmens Bond Surety Riders.
