DEPARTMENT RECOMMENDATION

Community Development Services, Department of Transportation (Transportation) recommends the Board approve and authorize the Chair to sign Easement Deed LD 2110-12-10003 (Easement), which grants to Pacific Gas and Electric Company and Pacific Bell Telephone Company dba AT&T California (PG&E) a Public Utilities Easement across County-owned parcel APN 079-030-13, for the Sly Park Road at Clear Creek Bridge Replacement Project, CIP 77115 (Project).  Granting the Easement is necessary to certify the right of way and utility coordination phases of the Project and facilitate construction of the bridge and associated improvements.

 

DISCUSSION / BACKGROUND

The Project requires the relocation of two PG&E poles along Sly Park Road.  During the preliminary right of way phase, Transportation determined that PG&E had prior rights to the location of the poles.  This required the County to obtain easements from several parcels for the new pole locations and for the benefit of PG&E.  To date, all of the easements on the private properties have been acquired.

 

The Project also required the County to acquire two parcels, APNs 079-030-13 and 079-030-19, in fee title as their size, shape, and location dictated that the entire parcels be purchased to accommodate the new bridge and approaches.  The PG&E pole relocations were to shift overhead powerlines across both of these County-owned parcels.  On March 7, 2017 (Item 19), the County granted an easement to PG&E across these parcels. 

 

In review of the construction phase, it was determined that one of the poles needed to be placed in a different location than initially proposed on APN 079-030-13.  The new pole location and additional area of work exists outside of the Public Utilities Easement previously dedicated by the County.  An additional Public Utilities Easement to PG&E is needed to accommodate the new pole location.

 

ALTERNATIVES

If the Public Utilities Easement is not executed the utility poles cannot be relocated and the Project could be delayed while an alternative design for either the bridge or utilities is pursued or the Project may not proceed at all.

CAO RECOMMENDATION

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

There is no funding or cost associated with granting the Easement.  The Sly Park Road at Clear Creek Bridge Replacement Project is funded by the Highway Bridge Program (86.4%), Road Fund (.6%), RSTP Exchange Funds (.2%), RSTP Match Funds (1.2%), and TIM Fees (11.6%).

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair's signature on two (2) originals of the Easement Deed.

2) The Clerk of the Board will return one (1) fully executed original of the Easement Deed to Transportation, to the attention of Jackie Cook.
