Environmental Management Department recommending the Board consider the following:
1) Accept payment program award in the amount of $53,472 through the State of California, Department of Resources Recycling and Recovery, Used Oil Payment Program, Cycle 9, Fiscal Year 2018-2019, for the term of July 1, 2018 through June 30, 2020; and
2) Delegate authority to the Environmental Management Department Director, or designee, to execute all payment program related documents, including but not limited to, requests for payments, reports, and all associated documents necessary to secure the payment program funds and implement the program.

DISCUSSION / BACKGROUND
Pursuant to Public Resources Code section 48600 of the California Oil Recycling Enhancement Act, the State of California, as administered by the Department of Resources Recycling and Recovery (CalRecycle), provides a maximum of $11 million per fiscal year in payments to local governments for implementation of local used oil and filter collection programs. The payment amounts awarded through this Used Oil Payment Program (Payment Program) are calculated on a per capita basis using the State of California, Department of Finance’s population statistics.
CalRecycle administers various payment programs and grants, and provides oversight for California’s waste handling and recycling programs, which are managed at the local level by cities and counties. CalRecycle’s procedures for administering payment programs and grant applications require the applicant’s governing body to declare by resolution certain authorizations related to the administration of these funds. The Board’s acceptance of the funds under this Payment Program will ensure that the Environmental Management Department (Environmental Management) is able to contribute to the promotion of used oil and used oil filter collection and recycling programs in El Dorado County.
Eligible costs using funds awarded under this Payment Program include, but are not limited to:
• Establishing, maintaining and/or enhancing used oil and used oil filter collection and recycling programs;
• Developing education materials informing the public about used oil and used oil filter collection and recycling;
• Purchasing or renting storage facilities dedicated to oil-related activities and supplies;
• Specific training; and
• Developing and purchasing used oil program materials.
On June 8, 2018, Environmental Management submitted an application to CalRecycle for this Payment Program (Attachment C).
In order to achieve the goals established for this Payment Program, Environmental Management intends to use the awarded funds for the following items:
• Provide public education and outreach regarding used oil storage, disposal, and handling:
• Purchase materials to provide to the public to promote proper collection of used oil:
• Install, remove, or update used oil collection sites within the County;
• Provide funding for employees to work household hazardous waste events where used oil is collected, events at the El Dorado County Fairgrounds speedway, and events at various marinas within the County; and
• Fund the disposal of used oil and used oil filters collected within the County.
In accordance with Board of Supervisors Policy A-6, the Board is the sole authority for accepting grant awards and approving grant agreements. On October 22, 2018, notification was received from CalRecycle advising award of the Payment Program, Cycle 9, Fiscal Year 2018-19, with payments to be issued in the spring of 2019; however, the amount of the award was not disclosed (Attachment D). On April 29, 2019, Environmental Management was notified that the check in the amount of $53,472 was received and deposited by the County prior to the Board accepting the funds awarded to the County under this Payment Program. The recommended acceptance of these funds authorizes the Director of Environmental Management, or designee, to execute all reports and associated documents necessary to secure and expend the funds for the purpose of implementing this Payment Program. Environmental Management will continue to obtain Board approval for the acceptance of all funds pursuant to Board Policy A-6.
Following acceptance of a grant award and approval of the grant agreement, Environmental Management is recommending the Board delegate authority to execute all documents, including, but not limited to, the grant funding agreement, amendments, requests for payment, reports, and all other associated documents necessary to secure and implement the approved grant or payment program.
ALTERNATIVES
The Board could choose to deny the acceptance of these Payment Program funds. This would result in the forfeiture of available Payment Program funds to the County and would further inhibit Environmental Management’s ability to promote used oil and used oil filter collection and recycling programs to the residents of the County.

County Counsel has reviewed and approved this Payment Program.

It is recommended that the Board approve this item.
FINANCIAL IMPACT
Approval of this item would allow the acceptance of $53,472 in State funding. No matching contributions are required for this Payment Program. These funds have been included in the department budget request as part of the Fiscal Year 2019-20 Recommended Budget.
