Title

Health and Human Services Agency (HHSA) recommending the Board:

1) Make findings that the Prevention and Early Intervention program services to be performed under Agreement 6885 with the California Mental Health Services Authority (CalMHSA), are in the public's best interest and that there are specialty skills, qualifications, and equipment not expressly identified in County classifications involved in the performance of the work in accordance with El Dorado County Ordinance Code, Chapter 3.13.030(B), El Dorado County Charter, Section 210(b)(6), and/or Government Code Section 31000;

2) Approve and authorize the Chair to sign Agreement 6885 with CalMHSA, to participate in the Statewide Prevention and Early Intervention Program for a maximum obligation of $174,758.40 ($58,252.80 per fiscal year), with a retroactive term of July 1, 2022, through June 30, 2025; and

3) Authorize the HHSA Director, or Behavioral Health Director, to execute further documents relating to Agreement 6885 including amendments that do not extend the term or increase the maximum obligation, and contingent upon approval by County Counsel and Risk Management.

 

FUNDING:  100% Mental Health Services Act (MHSA), specifically the Prevention and Early Intervention Program.

DISCUSSION / BACKGROUND:

In collaboration with the California Mental Health Directors Association (CMHDA), the California Mental Health Services Authority (CalMHSA) Joint Exercise of Powers Authority (JPA) was created in 2009, as authorized by California Government Code Sections 6500 through 6536 which permits two or more public agencies by agreement to jointly exercise powers common to the contracted parties. The CalMHSA JPA provides administrative and fiscal services in support of member counties for statewide training, technical assistance, and capacity building of the Proposition 63 Mental Health Services Act (MHSA) Prevention and Early Intervention (PEl) programs, as well as other programs as needed. The JPA also allows member counties the opportunity to collaborate for the administration of the statewide projects. Each member county has representation on the CalMHSA Board of Directors and the ability to attend, participate in, and vote on actions of the Board of Directors.

 

The County of El Dorado began participation with CalMHSA JPA on February 15, 2011, with the Board of Supervisors adopted Resolution 024-2011 (File ID 10-1324) approving membership in the JPA and authorizing the Health Services Department, Director of Health Services, to sign Agreement 142-O1111, as well as future ancillary documents with regard to the JPA and participation therein. MHSA funds paid by all participating counties to CalMHSA were used to participate in that original Agreement 142-O1111. The Agreement allowed the JPA to operate as the central entity in accordance with the guidelines established by the Mental Health Services Oversight and Accountability Commission, for the administration of three PEI Statewide Projects: Suicide Prevention, Student Mental Health Initiative, and Stigma and Discrimination Reduction.

 

On December 10, 2013, an Amended and Restated Joint Exercise of Powers Agreement (Agreement 279) was approved by the Board (File ID 10-1324, No. 5) as CMHDA and the member counties found that the originally approved JPA was too narrowly defined, thereby allowing CalMHSA to take on roles other than those that were initially contemplated. The Participation Agreement 279 remains active as a non-financial agreement for the purpose of documenting the eligibility to participate in various participation agreements as a member of the JPA and requires no further financial obligation. Beginning with the Fiscal Year 2021-2022, CalMHSA began invoicing participation in the Statewide PEI Program under Agreement 5860 (File ID 21-1179) which is now being renewed for a three-year term with Agreement 6885. Through this agreement, the Behavioral Health Division is able to continue to participate in statewide PEI programs that aim to reduce stigma and discrimination associated with mental illness, improve student mental health, and prevent suicide. These programs have been in operation for roughly five years and use training, awareness, and support to improve the lives of El Dorado County residents. The PEI Program is of indefinite duration and will continue as long as participating counties wish to act together to conduct projects in compliance with their respective responsibilities, however, the obligation to pay funds is limited to the periods and amounts stated in this agreement.

HHSA received the renewal agreement request for this retroactive PEI Program participation agreement 6885 for Fiscal Years 2022-23 through 2024-25 on July 13, 2022.  HHSA staff reviewed the agreement for processing and submission to County Counsel for review. HHSA is recommending Board approval of said Agreement.

 

ALTERNATIVES:

Should the Board decline to approve this recommendation, HHSA will be unable to pay its share of the Fiscal Year 2022-23 through Fiscal Year 2024-25 participation costs for the CalMHSA PEI Program, thereby excluding El Dorado community members from benefiting from statewide programs that aim to reduce the stigma and discrimination associated with mental illness, improving student mental health, and supporting suicide prevention.

FINANCIAL IMPACT:

There is no General Fund associated with this Agenda item. Sufficient appropriations were included in the Fiscal Year 2022-23 Budget and will be included in future budgets for the term of the Agreement.
