Title

Health and Human Services Agency (HHSA) recommending the Board:

1) Make findings in accordance with County Ordinance 3.13.030(e) that services may be provided under this Agreement 7481 because the work is with or among any other governmental entities or agencies;

2) Make findings in accordance with Procurement Policy C-17 Section 3.4(2(f)) exempting the competitive bidding process, with Purchasing Agent concurrence, because the procurement is for goods where the continuity of providers will provide efficiency or critical knowledge, and other providers of the goods cannot provide similar efficiencies or critical knowledge;

3)  Approve and authorize the Chair to sign Agreement for Services 7481 with El Dorado County Office of Education for the provision of Child Abuse Prevention Council Activities in the amount of $490,000, for the term of July 1, 2023, through December 30, 2025;

4) Authorize the Purchasing Agent to execute further documents relating to Agreement for Services 7481, including amendments which do not increase the maximum dollar amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management; and

5) Authorize the HHSA Director, or Assistant Director of Human Services to execute programmatic, administrative, and fiscal documents relating to Agreement 7481.

 

FUNDING:  22% Community-based Child Abuse Prevention allocation; 15% Promoting Safe and Stable Families allocation; 46% Child Abuse, Prevention, Intervention, and Treatment allocation; and 17% Children’s Trust Fund allocation.

DISCUSSION / BACKGROUND:

Child Abuse Prevention Councils (CAPCs) are required under Welfare and Institutions Code (WIC) 18983, which mandates that counties establish a CAPC to carry out specific legislated functions, including child abuse prevention and intervention programs.  On April 9, 2002, the Board established a CAPC and designated the Council as the Children’s Trust Fund Commission, pursuant to WIC 18966.  In 2009, the County began contracting with EDCOE to coordinate CAPC services (File ID 09-0054).  CAPC acts as an independent organization, functioning within County government, pursuant to WIC 18983.5.  The CAPC educational and training activities support child abuse prevention efforts throughout the County.

 

Services provided through this Agreement are funded in part by the Community-based Child Abuse Prevention allocation; the Promoting Safe and Stable Families allocation; the Child Abuse, Prevention, Intervention, and Treatment allocation; and the Children’s Trust Fund allocation.  The CAPC Coordinator develops, coordinates, and implements said services as they relate to the allocation mandates.

 

In July 2021, California’s Family First Prevention Services (FFPS) Program was established in WIC 16585 through 16589 as an opt-in program for County’s to develop and implement Title IV-E prevention services as part of comprehensive prevention, early intervention services and to address child well-being.  In accordance with WIC 16588, Counties opting into the FFPS Program are required to submit a Comprehensive Prevention Plan.  Additionally, there were new funding sources available to support the work. On April 19, 2022, the Board approved El Dorado County to opt-in to FFPS and accept additional funding to support the completion of the Comprehensive Prevention Plan components (File ID: 22-0608).

 

This proposed Agreement with El Dorado County Office of Education is a renewal of Agreement 4532 approved by the Board on June 9, 2020 (File 20-0348), its Amendment I approved by the Board on August 16, 2022 (File 22-1159), and its Amendment II approved by the Board on April 18, 2023 (File 23-0471) to provide the services described in Agreement 7481.  The proposed Agreement would ensure continuation of necessary CAPC services without any service interruption.

 

Under the County of El Dorado Board of Supervisors Procurement Policy C-17 Section 3.4, effective October 20, 2022, HHSA recommends, with El Dorado County Chief Administrative Office Procurement and Contracts Division concurrence, that competitive bidding requirements be waived for exemption reason (2(f)) because “the procurement is for goods where the continuity of providers will provide efficiency or critical knowledge, and other providers of the goods cannot provide similar efficiencies or critical knowledge.”

 

ALTERNATIVES:

Disapproval of Agreement for Services 7481 will result in an inability to meet funding source mandates.  Disapproval also will negatively impact HHSA’s ability to engage in community outreach to support child abuse prevention.

FINANCIAL IMPACT:

There is no General Fund cost associated with this Agenda item. Sufficient appropriations were included in the Fiscal Year 2023-24 Budget and will be included in future budgets for the term of the Agreement.
