1) Approve the continuation of perpetual agreement 427-M0810 between El Dorado County and Capital Southeast Connector Joint Powers Authority for the planning, design, and construction of the Capital Southeast Connector from Elk Grove to El Dorado Hills;
2) Approve payment of $55,000 as El Dorado County's contribution to the Joint Powers Authority operating costs for Fiscal Year 2024-2025; and
3) Authorize the Purchasing Agent to establish a change order to add funds to the agreement to process payment of the Joint Powers Authority operating costs for Fiscal Year 2024-2025.

DISCUSSION / BACKGROUND
On February 14, 2006 (Legistar File 06-0289) the Board entered El Dorado County as a member of the Capital Southeast Connector Joint Powers Authority (JPA). The JPA Board of Directors is comprised of one member from each of the following legislative bodies: Sacramento County, City of Elk Grove, City of Folsom, City of Rancho Cordova, and El Dorado County. The purpose of the JPA is to plan, design, construct, and maintain an improved roadway system (the "Southeast Connector") southeast of Sacramento between Elk Grove and El Dorado Hills. In El Dorado County, the Southeast Connector alignment will be White Rock Road between the County line and the U.S. 50/Silva Valley Parkway Interchange.
Board of Supervisors Policy C-17, Section 2.4, Perpetual Agreements, requires departments to obtain authorization from the Board of Supervisors, initially and on an annual basis, to utilize any contract that does not have a stated agreement term and exceeds the Purchasing Agent authority.
On October 5, 2009 (Legistar File 09-1189) the Board agreed to contribute $10,000 per year to provide the County’s share of the operating costs for the JPA. Subsequent increases to this yearly expenditure were approved by the Board as follows:
August 16, 2016 (Legistar File 16-0747), increase to $25,000
August 15, 2017 (Legistar File 17-0766), increase to $35,000
August 21, 2018 (Legistar File 18-1179), increase to $45,000
July 20, 2021 (Legistar File 21-1026), increase to $55,000.
Since the implementation of FENIX, each perpetual agreement must have a change order executed to allocate funding for payments in the upcoming fiscal year. This matter is intended to apprise the Board of the JPA perpetual agreement, to obtain Board concurrence with the payment of $55,000 towards the JPA's FY 2024-25 operating costs, and to recommend the Board authorize the Purchasing Agent to post a change order to ensure the County's ability to pay its portion of the JPA operating costs in FY 2024-25.
ALTERNATIVES
The Board may choose not to approve the perpetual agreement and not pay the annual contribution to the JPA's operating costs. Transportation would then work with County Counsel and return to the Board before taking any further action.

FINANCIAL IMPACT
The cost of Agreement 427-M0810 for the planning, design, and construction of the Elk Grove-Rancho Cordova El Dorado Connector has been included in the budget of the Fiscal Year 2024-25. Funding for this Project has been allocated from Road Fund, including $55,000 for next fiscal year. It is important to note that there will be no change to the Net County Cost as a result of this agreement.
