Department of Transportation recommending the Board consider the following for acquiring right of way for the Industrial Drive/Missouri Flat Road-Signalization, Capital Improvement Program Project Number 73366/36105053 approve and authorize the Chair to sign the Addendum to the Acquisition Agreement for Public Purposes from Irene Mazzoni, a single woman, for Assessor’s Parcel Number 329-260-01. The Addendum provides compensation for the replacement and reinstallation of a mailbox, in lieu of the County completing the work as originally agreed, at a cost of $1,308.50.
FUNDING: General Fund (52.4%), Accumulative Capital Outlay Funds (32.4%), and Tribe Funds (15.2%).

DISCUSSION / BACKGROUND
On March 8, 2016, Legistar 14-0133, Item 27, the Board approved the Public Safety Facility Project (Safety Facility) and associated Environmental Impact Report (2016 EIR), located in the Diamond Springs area, approximately three (3) miles southwest of the City of Placerville. The Safety Facility includes development of a multi-building public facility on approximately 11 acres of the 30.34-acre site for the El Dorado County Sheriff’s Department, with a maximum development potential totaling approximately 106,331 square feet.
Construction of the Sheriff’s new Public Safety Facility requires installation of a traffic signal at the Industrial Drive/Missouri Flat Road intersection to accommodate traffic utilizing the facility. The Industrial Drive/Missouri Flat Signalization Project (Project) will install a signal at the intersection of Missouri Flat Road and Industrial Drive, detector loops, and widening of both Missouri Flat Road and Industrial Drive to accommodate turn lanes.
Missouri Flat Road will be widened north and south of the intersection for right and left turn lanes. Industrial Drive will also be realigned slightly to the south and widened to accommodate a left turn lane and improve sight distance at the intersection. Concrete curb ramps will be constructed to Americans with Disabilities Act standards at three of the intersection legs along with crosswalks to accommodate pedestrians along Missouri Flat Road and Industrial Drive. The roadway pavement sections of Missouri Flat Road and Industrial Drive will also be reconstructed within the Project limits.
The Board approved the Acquisition Agreement for Public Purposes (Agreement) with Irene Mazzoni, a single woman (Seller), on September 10, 2019 (Item 12, Legistar 19-1158). As part of the Agreement, the Department of Transportation (Transportation) agreed to replace and reinstall a multi-use mailbox on the Seller’s property. The Seller recently approached Transportation to request payment in lieu of work that the County agreed to perform. The Seller is currently renovating the parking lot where the mailbox is located, and would like to replace the mailboxes while this work is happening rather than waiting for Transportation to replace the mailboxes at the end of the Project’s construction as originally stipulated. Construction of the Project is anticipated to be completed in 2022.
Transportation has reviewed the Seller’s proposal, and agrees that the request and the quote obtained for the work is reasonable. An Addendum to the Agreement has been drafted to provide compensation for the cost of the mailbox in lieu of the County completing the replacement and reinstallation thereof. Transportation recommends that the Board approves this Addendum.
ALTERNATIVES
If the Addendum to the Agreement is not approved, the Project will proceed as planned. The cost of the mailbox and its installation will be borne by the County when the work is completed at the end of the Project’s construction phase, as provided in the Agreement previously approved.

FINANCIAL IMPACT
This item will not result in any change to net County cost. The Project is included in Transportation’s 2020 Capital Improvement Program, which was approved by the Board on June 9, 2020 (Item 54, Legistar 20-0675). Funding sources include General Fund (52.4%), Accumulative Capital Outlay Funds (32.4%), and Tribe Funds (15.2%).
The cost of the mailbox as specified in the Addendum is $1,308.50, which will be paid directly to the Seller.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair’s signature on the Addendum to the Acquisition Agreement for Public Purposes.
2) The Clerk of the Board will return one (1) copy of the fully executed Addendum to Transportation, attention to Lindsay Tallman, for final processing.
