Community Development Agency, Development Services Division, recommending the Board consider Ordinance No. 5026 for a second reading and adopt Ordinance No. 5026 amending public notification requirements for new subdivision development projects (Title 120).
DISCUSSION / BACKGROUND
At the September 15, 2015, Board of Supervisors hearing, the Board unanimously approved Ordinance No. 5026 on the first reading, which approved the amendments to the County Code relating to increased public notice of land development applications and public hearings. The project, OR14-0001, included amendments to both the Zoning Ordinance and the Subdivision Ordinance, Titles 130 and 120, respectively. The amendments have been implemented; however, it was found by County Counsel that the amendments to Title 120 had to return to the Board for a second reading in order to fully execute the approval.
California Government Code Section 25131 requires a second reading except for ordinances that can only be adopted after a noticed public hearing. Title 130 can generally only be amended after a noticed public hearing (Govt. Codes 65853 - 65857), so those portions of the public notification changes in this title were not subject to the "second reading" requirement, but the changes to Title 120 are subject to that requirement.
